These Terms govern access to and use of ThisTimeIsDifferent (“the Service”). By creating an account, completing onboarding, or using the Service, you agree to them.

ThisTimeIsDifferent is a non-custodial software platform for paper trading, backtesting, and automated order placement via exchange APIs that you connect. We provide tools and infrastructure. We do not:
You must be at least 18 (or the age of majority where you live), able to form a binding contract, and legally permitted to trade digital assets and use exchange APIs in your jurisdiction. You are solely responsible for compliance with local law.
You must provide accurate registration information and keep credentials confidential. Enable two-factor authentication when available. You are responsible for all activity under your account and tenant, including actions by bots configured with your keys.
Nothing in the Service — strategies, signals, charts, backtests, paper results, AI sentiment, trade explainers, or documentation — is investment advice or a recommendation to buy or sell any asset. Past performance does not guarantee future results. You make every trading decision at your own risk.
You alone control which API keys you upload. You must use keys with minimum permissions (typically trade + read balance) and never enable withdrawal permissions for keys used with automated software. Losses from compromised keys, misconfigured permissions, exchange outages, or bot behaviour are yours.
Cryptocurrency and derivatives trading involve a substantial risk of loss, including total loss of capital. Leverage amplifies gains and losses. Automated trading can place orders faster and more frequently than a human — including when you are offline. Only trade with funds you can afford to lose entirely.
Multiple bots may share the same exchange account and net position per symbol (one-way mode). The dashboard attributes size per bot, but exchange margin, leverage, and liquidation apply to the aggregate position. Opposite signals, manual trades, partial closes, and dust can cause blocked entries, book-vs-exchange mismatches, or unexpected exposure. This is not sub-account isolation. Sentiment scores, explainers, and other AI-assisted outputs are informational only. They may be wrong, stale, or biased. They are not investment advice. You remain responsible for every order your bots place. Third-party AI providers have their own terms and limits.
Paid plans and add-ons charge for software access and infrastructure, not for investment performance. Prices are shown at /pricing and at checkout. Payments are processed by Stripe. Taxes may apply. Unless required by law or expressly stated in a promotion, fees are non-refundable once a billing period has started. Cancel or change plans via Billing when Stripe is enabled; access continues until the end of the paid period unless we state otherwise.

The Service, branding, UI, documentation, and software are owned by ThisTimeIsDifferent or its licensors. You retain rights to your strategy configurations and data you upload. You grant us a limited license to process that data solely to operate the Service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that bots will execute as you expect under all market conditions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR TRADING LOSSES, LOST PROFITS, LOST DATA, EXCHANGE FAILURES, LIQUIDATIONS, SLIPPAGE, OR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE IS LIMITED TO THE FEES YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM (OR USD 50 IF GREATER AND IF YOU PAID NOTHING). Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.
You will defend and indemnify ThisTimeIsDifferent and its operators against claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your API keys, your trading, or your violation of these Terms or applicable law.
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms, non-payment, abuse, legal risk, or to protect the platform. Termination does not cancel open exchange positions — you must manage those on the exchange.
We may update these Terms by posting a new version on this page with an updated effective date. Material changes may also be notified in-product or by email. Continued use after the effective date constitutes acceptance. If you disagree, stop using the Service and cancel any paid subscription.
